The Reverend was fighting to recall the white official of Benton Harbor that had attempted to take away the lake front Jean Klock Park and give it to developers and move the tax base to St. Joseph. He had hired citizens of the community to pass out flyers and the recall was successful. Even though there were only 3 questionalble ballots with a 54 ballot recall margin, the court reversed the vote. See the City clerk's affidavit. Judge Maloney in the People of the State of Michigan v. N. Jean Nesbitt, City Clerk of Benton Harbor and the City of Benton Harbor needed a reason to reverse this vote, and the Reverend Pinkney became their scape goat. Big money was involved.

The official that was recalled accused him of paying people to vote instead of handing out flyers. He was tried on these charges and had a mixed jury. The first attempt to convict him ended in a hung jury. They tried him a second time with an all white jury, and he was convicted. The judge, Alan Butzbaugh's Law Firm shares an address with Law & Title Realty, LLC at 811 Ship Street in St. Joseph. This is the realty company that is developing most of Jean Kock Park. We do know that he is president of Law & Title Building Condominium Association. That certainly sounds like enough of a conflict of interest that he should have recused himself from the case.

The issue is simple. Was he guilty of paying people to vote to get rid of a city official? The Berrien County Sherrif's Department was not convinced that he was guilty. They sent him to Detroit to take a battery of lie detector tests, which he passed with flying colors. Now the Berrien County Judge has not taken those tests into account, nor has he taken into account the fact that he was not tried by a jury of his peers. Was the judge right? Currently, he is President and Director of the "Law and Title Building Condominium Association," whose address is 811 Ship Street, St. Joe. MI Corporate ID #: 824077. David F. Upton is VP.

 

Also located at 811 Ship Street is the "Law and Title Reality, LLC."

 

The "Law and Title Realty, LLC" has numerous aliases, including, "Ship Street Reality," "COUNSELORS-SHIP STREET REALTY," and "COUNSELORS REALTY.com" All share the same MI Corporate ID # B58808

Now, "Ship Street Realty" is a doubled. "Ship Street Realty" is on 811 Ship Street in St. Joe (B58808), AND "Ship Street Realty" 325 W. Main Benton Harbor (B2126U).

 

Tod A Marsh is the agent for "Ship Street Realty" in its Benton Harbor Location. At its Benton Harbor address "Ship Street Realty(B2126U)," is legally titled the "ALL AMERICAN GROUP, LLC." It too has 4-5 other aliases.

Why was this Judge allowed to preside over the case of someone whose case is inextricably linked to Harbor Shores, and all its preludes?
